Acceptance of Terms

Welcome to Constellar Creative's Client Portal. By accessing or using our portal, you agree to comply with and be bound by the following Terms of Service. Please read them carefully. If you do not agree to these terms, you must not use the portal.

Definitions

  • Agency: Refers to Constellar Creative, LLC, a marketing agency headquartered in Clearwater, Florida, specializing in content marketing for financial advisors.

  • Client: Any individual or organization accessing the portal for services provided by the Agency.

  • Portal: The online platform provided by the Agency for Client interactions, information, and service exchanges.

Roles and Responsibilities

  • Agency Responsibilities: Provide access to the portal, ensure its operational status, and maintain compliance with applicable federal and Florida state regulations.

  • Client Responsibilities: Use the portal in compliance with these terms, provide accurate information, and maintain confidentiality of account credentials.

User Rights

  • Clients have the right to access the portal as intended for business operations and collaboration with the Agency.

  • The Agency reserves the right to modify, suspend, or terminate access to the portal at its discretion.

Limitation of Liability

  • The Agency's liability is limited to the maximum extent permitted by law in the State of Florida. Clients agree that the Agency shall not be liable for any indirect, incidental, or consequential damages arising from the use of the portal.

Data Usage Policies

  • Data collected via the portal will be used in accordance with the Agency's Privacy Policy.

  • The Agency complies with U.S. data protection laws, including the CCPA. Clients consent to the collection and use of data as per these regulations, and as governed by Florida privacy laws.

Confidentiality

  • All information shared within the portal is considered confidential and must not be disclosed to unauthorized third parties.

Compliance with Financial Regulations

  • The Agency complies with applicable financial regulations, including SEC and FINRA rules.

  • Clients acknowledge their awareness of and compliance with these regulations as applicable to their operations.

Account Creation, Access, and Termination

  • Account Creation: Clients must provide accurate information during account setup.

  • Access: Clients are responsible for maintaining the confidentiality of their login credentials.

  • Termination: The Agency may suspend or terminate accounts for violations of these terms. Clients may terminate their accounts by contacting the Agency.

Dispute Resolution

  • Any disputes arising from these terms shall be resolved through arbitration in accordance with the laws of the State of Florida.

Periodic Updates

  • The Agency reserves the right to update these terms periodically. Clients will be notified of significant changes and continued use of the portal constitutes acceptance of updated terms.

Acceptance Mechanism

  • By completing the registration process and creating an account, Clients acknowledge their understanding and acceptance of these terms. This acceptance forms a legally binding agreement between the Client and the Agency.

Governing Law

  • These terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
